We recommend that you read this Policy carefully; it will help you make informed decisions about sharing your personal information with us.
The terms used in this Policy have the same meaning as in our Terms of Use, which you should read in conjunction with this Policy. By accessing our website and using our service, you agree to the terms of this Policy and our Terms of Use.
Chick collects your personal information as part of its provision of the Chick Commerce Cloud Software as a Service (SaaS) platform.
The Service involves the storage of data about a company or individual, which can include personal information. This personal information is about an identifiable individual and may include their name, email address, telephone number, address details and other relevant information.
Chick may collect personal information directly from you when you:
Register to use the service, make use of it, post on the Merchant.chat Community forum or our blog, get in contact with the Chick support team, and take a look at our website. If you don't want to give us your personal information, this may mean we can't provide you with the service.
Chick may receive personal information from you about other people and organisations
If you give Chick personal information about someone else while using the Service, you must make sure that you are allowed to share that information with Chick.
Chick can use and share that information for the purposes outlined in the Service's policy without needing additional permission from the person you provided the information about. You should inform the individual about the details of Chick's policy and obtain their consent before sharing their personal information.
If Chick asks you to, you should help the individual to access or update their personal information that you have shared with Chick through the Service.
Chick uses and stores your personal information for specific purposes
Chick collects your personal information in order to provide you with the Service and any related services you may request. This information may be used for various purposes related to the Services, including verifying your identity, administering the Service, notifying you of new or changed services, carrying out marketing or training related to the Service, assisting with technical support issues, complying with laws and regulations, and communicating with you. By using the Service, you agree to the collection, storage, and use of your personal information for these purposes, as well as any other purposes you authorize.
It is your responsibility to keep your Service password secure. If you suspect that your password has been misused, you should contact us as soon as possible and change your password using the "Forgotten Password" process. Chick can aggregate Your non-personally identifiable data
When you use the Service, you give Chick permission to access, compile, and utilize non-personally identifiable data that Chick has collected from you. This data will not identify you or any other individual in any way.
Chick may use this compiled non-personally identifiable data to:
- Help us understand how our customers are using the Service,
- Provide our customers with additional information about the Service's uses and benefits,
- Improve small business productivity by generating useful business insights from the aggregated data, and enabling you to compare your business performance to that of others in the aggregated data, and
- Generally enhance the Service.
Chick stores your personal information on its and other company's infrastructure.
Any data that you enter into the Service, whether personal or non-personal, or that is automatically imported on your instruction, is transferred to Chick's infrastructure as part of the transmission over the internet. By using the Service, you agree to the transfer of your personal information to Chick's infrastructure as described in this Policy.
Chick's infrastructure is currently hosted in Australia and the USA, and your data will be hosted in the region that makes the most sense for you. For redundancy purposes, backups of your data may be stored in regions other than where the primary data store resides.
By providing your personal information to Chick, you agree to Chick storing your personal information. While your personal information will be stored on Chick's infrastructure, it will remain under Chick's effective control at all times. The role of the infrastructure host is limited to providing hosting and storage services to Chick, and Chick has taken steps to ensure that the infrastructure hosts do not have access to, and use the necessary level of protection for, your personal information.
For redundancy purposes, Chick may backup data to a region other than where it is primarily stored. If you do not want your personal information to be transferred to infrastructure located in another region, you should not provide Chick with your personal information or use the Service.
Chick implements measures to safeguard your personal information.
Chick is dedicated to safeguarding the security of your personal information and takes all reasonable precautions to protect it from unauthorized access, modification, or disclosure. Your personal information is stored on secure infrastructure, and all data transferred between you and the Service is encrypted. However, it's important to note that the internet is not inherently secure, and we cannot guarantee that your information will be secure at all times. Transmitting personal information over the internet is done at your own risk, and you should only enter personal information into the Service within a secure environment.
If we become aware of a security breach where your personal information is lost, stolen, accessed, used, disclosed, copied, modified, or disposed of by any unauthorized persons or in any unauthorized manner, we will inform you at the first reasonable opportunity.
Chick only shares your Personal Information in restricted situations.
Chick will only share the personal information you have provided us with outside of the Chick group of companies if it is necessary and appropriate to facilitate the purpose for which your personal information was collected, as outlined in this Policy, such as to provide you with the Service.
We will not disclose your personal information to a third party without your express consent, except in cases where we are required to comply with court orders, subpoenas, or other legal process or investigation, including by tax authorities, if such disclosure is mandated by law. Where possible and appropriate, we will inform you if we are legally obligated to disclose your personal information.
The third-party hosts of our infrastructure are not authorized to access or use your personal information, except for the limited purpose of storing the information. As a result, Chick does not currently share personal information with third parties located outside of our organization.
Chick does not retain or store your credit card information.
If you choose to pay for the Service by credit card, your credit card details are not stored by the Service and cannot be accessed by Chick staff. Your credit card details are encrypted and securely stored by Stripe to enable Chick to automatically bill your credit card on a recurring basis. You should review Stripe's Privacy Policy to ensure you are comfortable with their practices.
You may request access to your personal information.
It is your responsibility to ensure that the personal information you provide us is accurate, complete, and up-to-date. If you would like to access or modify your personal information, please email us at info@chickcom.com with your request.
We will process your request as quickly as possible, as long as it does not conflict with any legal obligations. If we are unable to fulfill your request, we will inform you of the reason. For instance, we may be unable to provide you with the information you require if it would compromise the privacy of others or if it is not feasible to process your request in the way you have requested. In certain circumstances, we may need to coordinate access to your personal information through an intermediary, such as the Subscriber.
Please be aware that we will only keep your personal information for as long as we require it to provide you with the Service. However, we may have to retain some of your personal information for a specified period of time.
Chick uses cookies
When providing the Service, Chick may use "cookies," which are small text files stored on your computer for record-keeping purposes. These cookies do not contain personal information and do not identify you as an individual, but they do identify your computer.
We and some of our affiliates and third-party service providers may use a combination of "persistent cookies" (cookies that remain on your hard drive for an extended period) and "session ID cookies" (cookies that expire when you close your browser) on the Website. This is done to track overall site usage, and to track and report on your use and interaction with ad impressions and ad services.

At this time, we do not respond to or adhere to "Do Not Track" requests.
You have the option to unsubscribe from marketing communications at any time.
Chick might send you emails about billing, products, Service updates, and notifications. You can unsubscribe from non-critical mailing lists by following the simple instructions included in our emails. If you request it, we will take you off the list.
It is your responsibility to transfer data to and from third-party services, and we take no responsibility for these transfers.
As the merchant, you may be able to transfer your data, including personal information, to and from third-party applications using the Service. It is your responsibility to check the privacy policy of these applications and understand how they handle personal information. Chick is not responsible for the privacy practices or content of these applications.
Chick has a process for handling privacy complaints.
If you have a complaint about how we have handled your personal information, please contact our Privacy Officer with all the relevant details and supporting documents by emailing info@chickcom.com or sending a letter to Chick Commerce Pty Ltd, PO Box 5036 South Turramurra NSW 2074 Australia. Our Privacy Officer will respond to your complaint within 10 business days and investigate and attempt to resolve it within 30 business days or longer if necessary. Please note that this policy may be updated from time to time, and any changes will be communicated to you through email or notification via the Service. By continuing to use the Service, you accept any amended Policy.
Definitions
When using the Service, terms such as "Data Processor", "Data Subject", "Processor", "Processing", "Subprocessor", and "Supervisory Authority" should be interpreted according to applicable Data Protection Legislation. "Data Protection Legislation" includes General Data Protection Regulation, Regulation (EU) 2016/679, European Directives 95/46/EC and 2002/58/EC, and any implementing legislation or regulation. "Personal Data" refers to information about a Customer who visits or transacts on your Chick Commerce Cloud online shop that Chick processes as a Data Processor when providing you with the Services.
